Title X LLC provides title insurance, escrow and settlement services. This policy explains what we collect through titlexco.com and through our services, how we use it, who we share it with, and what you can ask us to do about it.

What we collect

From you: name, email, phone, address, company and role; property address, sales price, loan amount and closing date; borrower, buyer, seller, loan officer and lender details on an order; identification documents and signatures; and anything you put in a message or chat.

From others: public records including deeds, mortgages, liens, judgments and tax records; the other parties to your transaction; underwriters and search vendors; and identity verification services.

Why we use it

To open, examine, clear, close and record an order. To verify identity and prevent fraud, including wire fraud. To communicate with you and the other parties. To issue commitments and policies and work with our underwriters. To answer inquiries. To operate and secure the site. To meet legal, regulatory, licensing, underwriting, audit and retention obligations. We do not make automated decisions that produce legal or similarly significant effects about you.

Who we share it with

The other parties to your transaction and their representatives; our underwriters, currently First American and Westcor; search, abstracting, notary, recording and courier vendors; technology providers under contract and only for purposes we specify; banks involved in funding and disbursement; government agencies, courts and recording offices; professional advisers, auditors and regulators, and any party where the law requires it; and a successor if Title X is party to a merger or sale.

We do not sell your personal information and we do not share it for targeted advertising. We run no advertising or retargeting tags.

How long we keep it

We keep transaction records for as long as we need them for the transaction, and then for the longer of any period required by law, by our underwriters, or by the applicable state licensing authority. Affiliated business arrangement disclosures are kept for five years after execution, under Regulation X. We delete or de-identify information when we no longer need it, unless we are required to keep it.

How we protect it

Encryption in transit and at rest, access limited to those who need it, monitoring and logging, background screening for staff with access to funds or nonpublic personal information, and written incident response procedures. Title X is certified under the ALTA Best Practices Framework. No system is completely secure. If we become aware of a breach affecting your information we will notify you and the authorities as required.

Your rights

You can ask us to confirm what we hold and give you a copy, correct it, delete it where we are not required to keep it, stop marketing email, or stop calling or texting. Depending on where you live you may also have the right to opt out of targeted advertising or of any sale or sharing, to limit use of sensitive information, and to appeal a refusal. We will not discriminate against you for asking.

Two industry points. Much of a title file comes from public records, which we cannot delete or correct at source. And much of what we hold is regulated by the Gramm-Leach-Bliley Act, which limits deletion while a transaction is open or a retention requirement applies.

Wire fraud, other people, third parties, children, changes

We will never send wiring instructions by unencrypted email or email you to say they have changed. Call (866) 276-9271 to verify before sending funds. If you give us information about someone else, you confirm you are entitled to. Our site links to and embeds third-party services including Qualia, whose own notices apply. The site is for users aged 18 and over. We may update this policy; the date above shows when it last changed.
